IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF $100 USD OR THE AMOUNT YOU PAID US FOR THE SERVICE IN THE LAST SIX MONTHS.

SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF CERTAIN WARRANTIES OR THE LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

You agree to defend, indemnify, and hold harmless Dumpster Rental Enterprises, its licensors, licensees, affiliates, and their respective employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, liabilities, losses, costs or debts, and expenses (including attorneys’ fees) arising from or related to: (a) your use of and access to the Service; (b) any breach of these Terms; or (c) your violation of any law or the rights of a third party.

10. Governing Law and Jurisdiction

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.
